Kevin Sampson the great-grandson of Dorothy Louise Sampson (the Testator) claims a ? interest in a property devised to him and the first defendant by the Testator subject to a life interest. The first defendant assumed exclusive possession after the life tenant's death and Sampson seeks a declaration of entitlement. The case involves mistakes about property ownership with Sampson learning of his interest in 2012. The defendants sought to strike out the claim primarily based on limitation defenses. The court considered whether Sampson could amend his claim to fit within exceptions to the limitation period focusing on mistakes and reasonable diligence in discovering them.
